Terms of Service

Welcome to aptitudespace.com, operated by Sudip Karmakar, trading
as AptitudeSpace, Kolkata, India ("we", "us"). These Terms apply
when you use our website or buy our courses and assessments. Our
courses are delivered through our learning platform partner,
Learnyst. Please read these Terms before purchasing.

1. Who holds the account

Accounts are created and managed by a parent or legal guardian
aged 18 or over, who accepts these Terms on behalf of the student.
The parent or guardian is responsible for the student's use of the
account.

2. Your licence to use our content

When you buy a course or assessment, you receive a personal,
non-transferable licence for ONE student to use it for their own
exam preparation during the access period shown on the course page.
* No sharing: an account may not be shared between students,
siblings, friends or families.
* Tutors and institutions: tutors, tutoring centres and schools may
not use a single licence for several students or present our
materials to a group. Please contact us for group licences.

3. Intellectual property

All test questions, mock exams, solutions, guides, videos, text,
graphics and software on aptitudespace.com and in our courses are
owned by us or our licensors and are protected by copyright. You
may not copy, screenshot, screen-record, download (except where a
download button is provided), distribute, publish, sell or create
derivative works from our materials, or use them to train any AI
model.
This does not prevent you from keeping or confidentially sharing
material reasonably necessary to get support, obtain legal advice,
make a complaint or exercise a legal right. Contact us for
accessible formats or reasonable adjustments. Statutory exceptions
and rights are unaffected.
Students own their original essays. You permit us and our service
providers to process them only to deliver marking, feedback,
support and the related services described in our Privacy Policy.
We will not publish an identifiable essay without separate
permission.

4. Writing tasks and AI-assisted marking

Each writing task allows one marked submission. Writing (essay)
tasks are marked with the help of AI tools, including Claude by
Anthropic, using our marking rubric. If you believe feedback or a
score is wrong, contact us and we will review it. See our Privacy
Policy for how essay text is handled.

5. Fair use and security

You agree not to disrupt the platform, bypass its security, use
bots or automated tools to access or copy content, or reverse-
engineer the testing interface.

6. What we do and do not promise

Our courses are practice and preparation tools. We are not an
official testing body and we do not guarantee any particular score,
selection, school placement or scholarship; results in the real
exam depend on many factors outside our control. We will supply our
services with due care and skill, as described on our website.

7. Your rights under the law

Nothing in these Terms excludes, restricts or modifies any right,
guarantee or remedy under the Australian Consumer Law or another
law that cannot be excluded. Where a consumer guarantee is not met,
you are entitled to the remedies available under that law,
including any applicable refund, rectification and compensation for
reasonably foreseeable loss or damage. We do not limit those
remedies to supplying the service again or paying for it to be
supplied again.

8. Suspension and termination

If you materially breach these Terms (for example, by sharing an
account or distributing our materials), we may suspend or end your
access. Any suspension will be proportionate and limited to what is
reasonably necessary. Except where urgent action is needed to
protect our content or other users, we will first tell you what we
believe happened and give you a chance to respond; after urgent
action, we will promptly explain it and allow you to respond. Before
ending access for a breach that can be remedied, we will give you a
reasonable opportunity to remedy it.
If we end your access, we will refund the unused part of your
prepaid access period within 14 days, less any amount we are
legally entitled to keep for proven loss caused by the breach
(without double recovery), and we will explain any deduction. Your
statutory rights are unaffected.

9. Changes to these Terms

We may update these Terms from time to time, for example to reflect
changes in the law or our services. The version in force when you
buy a product applies to that purchase, and we will not make a
change that materially reduces what you paid for during its access
period. Significant changes will be shown by a new date at the top
of this page and, where practical, by email.

10. Governing law

These Terms are governed by the laws of India. This does not remove
any protection you have under the mandatory consumer laws of the
country where you live, including the Australian Consumer Law, and
you may bring proceedings in the courts of your country where those
laws allow.
